A local authority in the north-west is looking for a locum solicitor in the planning and property department to join their team.

You will be working as part of a small team covering leave and mainly be working on planning matters such as s106's and enforcement notices as well as general advice on planning matters.

The role is full time with flexible attendance. (Remote or in office)

The contract will be for more or less a year

Property responsibilities will include:

  • Working with and advise officers, Members and project teams of the Council on matters relating primarily to property law and practice including high value and complex acquisitions and disposals, regeneration schemes, new development schemes, leases and licences.
  • Supporting the negotiation of the legal and commercial terms for property related transactions and agreements and to draft relevant documentation including transfers, agreements, commercial leases, licences, easements
  • Protecting and promoting the council’s interests in the course of all advice, drafting, negotiations and advocacy, and to ensure that all deadlines are met and all procedures followed correctly
  • Developing and maintain effective client relationships
  • Supporting performance monitoring by ensuring that relevant information is recorded as instructed
  • Promoting equality of opportunity and valuing diversity within the service;
  • Ensuring that all processes are carried out in accordance with current legislation, regulations and Council policy, with particular emphasis on Health & Safety, customer care and data protection;
  • Training and other duties which are commensurate with the grading and responsibility of the post.

Planning responsibilities will include:

Drafting, negotiating and progressing Town and Country Planning Act 1990 s.106 agreements and unilateral undertakings within the context of CIL compliance.

• Planning inquiries – care and conduct of complex planning inquiries and appeals and the Independent Examination into the Local Plan, if so required, including instructing counsel on behalf of the Director of Development Services including drafting the statements of case and common ground for the Council and working with the planning team to prepare the case for the Council.

• Ensuring that the legal team provides support to the Development Management (DM) Committee which includes attending Chairman’s Briefing and Committees to advise on planning matters and committee procedure and process

• Liaising with Development Management team to provide comprehensive legal support including, reading and advising on draft reports, including putative conditions, to DM Committee and assisting with finalising Committee minutes.

• Advising in respect of Community Infrastructure Levy Regulations

• Researching and maintaining an in depth of current law and practise in planning and support as required

• Ensuring that inquiries from members of the public are responded to promptly and appropriately

• Undertaking any other duties that may be commensurate with the level of the post
